These General Terms and Conditions of Sale (hereinafter the "Terms") apply to all services provided by DOMANIUM, a simplified joint-stock company (SAS) with a share capital of €1,000, registered under SIRET number 999 748 817 00015, whose registered office is located at 2 Chemin du Planil, 69510 Yzeron, France (hereinafter "DOMANIUM").
These services include the annual rental of residential pitches, the annual rental of accommodation, and the rental of short-stay pitches within its holiday parks.
Any booking or execution of a contract constitutes full and unconditional acceptance of these General Terms and Conditions.
DOMANIUM provides the following three categories of services:
Annual Pitch Rental: The annual rental of a pitch intended to accommodate the Customer's mobile home. This service is subject to a fixed one-year contractual commitment.
Annual Mobile Home Rental: The annual rental of a fully equipped mobile home provided by DOMANIUM and installed on the holiday park. This service is subject to a fixed one-year contractual commitment.
Short-Stay Pitch Rental: The provision of a pitch for a short stay for travellers wishing to enjoy a stay at one of the DOMANIUM holiday parks.
For annual pitch rental or annual mobile home rental, the contract is concluded by the execution of an annual rental agreement between DOMANIUM and the Customer. The agreement takes effect on the date agreed by the parties.
For short-stay pitch rentals, the booking is confirmed upon receipt of DOMANIUM's written confirmation by email.
The prices applicable to the services are those in force at the time of booking or execution of the rental agreement. For annual pitch rental and annual mobile home rental, prices are set at the beginning of each year and communicated to Customers prior to any renewal. DOMANIUM reserves the right to amend its prices at any time. Any revised prices shall apply to new agreements and renewals.
For annual pitch rental and annual mobile home rental, payment shall be made by direct debit in accordance with the payment schedule specified in the rental agreement.
For short-stay pitch rentals, payment shall be made by bank transfer prior to arrival at the holiday park, unless otherwise agreed in advance by DOMANIUM.
Any late payment may result in the suspension of access to the services provided at the holiday park and, where applicable, the termination of the rental agreement.
For short-stay pitch rentals, DOMANIUM operates a flexible cancellation policy. Any cancellation made within the applicable notice period before the scheduled arrival date will be eligible for a full refund. The detailed cancellation terms are communicated at the time of booking.
For annual pitch rental and annual mobile home rental, the Customer enters into a fixed one-year commitment. Any early termination shall require the prior written agreement of both parties. At the end of each one-year term, the rental agreement may be renewed in accordance with the terms mutually agreed by the parties.
The Customer undertakes to use the allocated pitch only for its intended purpose, to comply with the holiday park's internal regulations, not to disturb the peace and quiet of other Customers, and to keep the pitch clean, tidy, and in good condition throughout the rental period.
DOMANIUM commits to providing a location that complies with the subscribed service, to ensuring the security and maintenance of the domain within reasonable timeframes, and to communicating any price changes before their implementation.
DOMANIUM shall not be liable for any theft, loss of, or damage to the Customer's personal property while on the holiday park. Each Customer is solely responsible for arranging appropriate insurance to cover their mobile home and personal belongings.
These General Terms and Conditions shall be governed by and construed in accordance with the laws of France. In the event of any dispute, the parties shall first seek to resolve the matter amicably. Failing such resolution, the courts having jurisdiction over the registered office of DOMANIUM shall have exclusive jurisdiction.
DOMANIUM reserves the right to amend these General Terms and Conditions at any time. Any amendments shall take effect upon publication and shall apply to all new rental agreements and renewals.
